Terms and Conditions

1. Agreement

These terms and conditions (‘agreement’) are intended to provide clarity and transparency in your interactions with Northlight Communications Ltd and Leonie Roberts. By using our services and products, you are entering into a legally binding agreement. You are indicating your acceptance of these terms and conditions. If you disagree with any part of these terms, please avoid using our services or products.

2. Services and products

Northlight Communications Ltd and Leonie Roberts offers a range of services and products to valued customers. All are provided subject to availability and compliance with applicable laws and regulations.

3. Pricing

The cost of our services and products will be transparently communicated to you through our website, via our customer service representatives, or in writing upon request. All prices are quoted in GBP (British Pounds) and DO NOT include VAT unless explicitly stated otherwise. Additional charges may apply under certain circumstances.

4. Payment

We try to make payment procedures as straightforward as possible. Payment for services rendered is 40% upfront and 60% on the successful conclusion of the work or delivery.

Our accepted payment methods include cash, bank transfer, credit/debit cards, and other mutually agreed-upon methods. Invoices will be provided for all transactions, offering a comprehensive breakdown of the services and products and associated costs.

Payment is on 30 day terms.

The Late Payment of Commercial Debts (Interest) Act 1998 applies to this invoice. If payment is not made within 30 days, then interest will be charged at a flat rate of 10% at the date the payment fell due from that date until payment is made. A statutory interest charge of 10% will be applied to any payments outstanding after 30 days, PLUS a fixed charge for the recovery of a late payment of: £40 for debts under £1,000; £70 for debts of between £1,000 and £10,000; £100 for debts over £10,000.

5. Cancellations and rescheduling

We request a minimum of 48 hours’ notice for cancellations or rescheduling of service appointments or product orders. This advanced notice enables us to better manage our schedule and allocate resources efficiently. Failing to provide the required notice may result in a cancellation fee. We do, however, recognise that emergencies can arise, and we will do our best to find an alternative solution in those circumstances.

6. Liability

Our commitment to excellence extends to the services provided. While we go to great lengths to ensure the accuracy, reliability, and safety of our services and products, it’s important to note that Northlight Communications Ltd shall not be held liable for any losses, damages, or expenses incurred as a result of using our services or products. This includes, but is not limited to, indirect, incidental, or consequential damages. Clients are encouraged to exercise discretion and due diligence when using our services.

7. Insurance

The well-being of our customers and team members is of paramount importance.  Northlight Communications Ltd is fully insured for public liability. Our comprehensive insurance coverage serves to mitigate potential risks and unforeseen accidents that may arise during the provision of our services or products.

8. Health and safety

The safety and security of our clients and team members is integral to our operations. In instances where our team identifies potential health and safety hazards on the premises, we reserve the right to either postpone or cancel the service or product delivery until such hazards have been adequately addressed. This proactive approach ensures the well-being of all parties involved.

9. Data protection

Respecting your privacy and safeguarding your personal information are core principles at Northlight Communications Ltd. We collect and process personal data in accordance with the Data Protection Act 2018 and the General Data Protection Regulation (GDPR). By using our services, you provide your consent for the collection, processing, and storage of your personal data for the sole purpose of delivering the requested services or products and maintaining an organised customer database. I am registered with the Information Commissioner’s Office (ICO).

10. Photography

When I undertake photographic assignments and commissions for commercial, public relations and editorial photography, the terms and conditions are as below:

i. Copyright: Unless agreed in advance and in writing, I do not assign copyright to any clients or third parties. Please be aware that buying the copyright is much more expensive than buying an extensive and wide-ranging license.

ii. Licences: As a client, you would be granted a license to reproduce and/ or distribute photographs. All licenses have geographical, time, media and usage restrictions. Any use of photographs outside the terms of the license granted would be a breach of copyright.

iii. Licence extensions: Contact me for options on extending your licence.

iv. Delivery method and deadlines: We will agree how, when, and where the photographs will be delivered before the photography session. Options can include web galleries, email, WeTransfer and USB flash drives. Photographs will be supplied in the agreed format within the agreed deadline. Copies of all files will be retained in line with industry best practice and any subsequent re-issue of any or all of the image files will be subject to a charge equal to the actual cost of producing and delivering them plus a 20% service charge.

v. Invoicing and payment: Fees and costs will be negotiated and agreed before the commission date. If details of the commission change, alterations to the costs will be agreed as soon as possible. New clients will be asked for a purchase order or a letter confirming the commission, agreed fees and costs as well as acceptance of my terms and conditions in advance.

When photography is part of the public relations offering, I invoice for 40% payment before completion of the public relations contract. Once the commission has been agreed, the contract will include payment terms. I will send a second invoice to you with the remaining 60% for payment after completion of the contract.

The grant of licence will only come into force once payment has been made in full. VAT will be charged where the law requires. If the client postpones or cancels the commission within 72 hours of the start time I reserve the right to charge 50% of the agreed fees. Cancellations or postponements within 24 hours of the start time may be charged at 100% of the agreed fees.

vi. Limit of liability: As a professional public relations consultant and photographer, I take great care and pride in my work and in my relationship with clients and the subjects of my photography.

I cannot accept liability for unexpected events including: poor weather, industrial disputes, sickness or injury, equipment malfunction, model release disputes, property release disputes and other actions or accidents that are outside my control and cannot be reasonably predicted. 

I carry separate public liability insurance to the value of £1 million each for both public relations advice and photography services. My photographic equipment is regularly tested and serviced. If you require any specialist insurance to be taken out for your project, the cost will be included in the fees. Back-up copies are stored using reliable methods but I cannot accept liability for systems failures.

11. Governing law

This Agreement is subject to the laws of England and Wales and is to be construed in line with these laws. Any disputes arising from this Agreement will be subject to the exclusive jurisdiction of the courts of England and Wales.

12. Changes to terms and conditions

Please note that Northlight Communications Ltd reserves the right to modify or amend these Terms and Conditions at any time. Any updates will be promptly communicated through our website. By continuing to acquire our services or products, you acknowledge and accept the revised terms.

In engaging Northlight Communication Ltd’s services or products, you are acknowledging that you have read, understood, and agreed to abide by these Terms and Conditions.
